ECHIVERRI MANANATILI BILANG MAYOR

Mananatili bilang punong lungsod si Caloocan City Mayor Enrico “Recom” Echiverri matapos maglabas ng Writ of Preliminary Injunction ang Regional Trial Court (RTC) upang pigilan ang Department of Interior and Local Government (DILG) sa paghahain ng suspension order laban sa alkalde at tatlo pang opisyal ng lungsod.

Base sa dalawang pahinang kautusan na inilabas ni Caloocan City RTC Branch 125 Judge Dionisio Sison, pinaboran nito ang inihaing petisyon ng kampo ni Echiverri upang makakuha ng Writ of Preliminary Injunction.

Isa sa mga isinumiteng dokumento ng kampo ni Echiverri sa sala ni Judge Sision upang makakuha ng Writ of Preliminary Injunction ay ang naunang desisyon ni RTC Branch 128 Eleonor Kwong na naunang naglabas ng tatlong araw na TRO.

Nakasaad dito na “Without delving into the propriety of the TRO (Temporary Restraining Order), which is legal issue that is solely subject to the determination of the courts, nor into the merits of all the cases now pending, as matters stand at present, the DILG has been enjoined to refrain from implementing the order of preventive suspension issued by the Office of the Ombudsman. Any action to of the DILG which is contrary to the TRO might just add to the now series of cases brought in connection with the main case still pending at the Office of the Ombudsman”.

Matatandaan na unang nagsampa ng kaso si Vice Mayor Egay Erice sa Office of the Ombudsman noong July ng nakalipas na taon laban kina Echiverri, City Treasurer Evelina Garma, City Budget Officer Jesusa Garcia at City Accountant Edna Centeno dahil umano sa hindi pagbabayad ng monthly contribution ng mga city hall employees sa Government Service Insurance System (GSIS).

Matapos lamang ang isang araw ay naglabas ng kautusan si dating acting Ombudsman Orlando Casimiro na nagbibigay ng six month preventive suspension kay Echiverri at sa tatlo pang city hall officials.

Agad namang naghain ng mosyon ang kampo ni Echiverri sa Court of Appeals hanggang sa maglabas ang mga huwes ng TRO upang pigilan ang suspension order at hindi naglaon ay naglabas naman ang mga ito ng injunction ngunit nitong unang linggo ng Enero ay binabalewala ng CA ang kanilang naunang inilabas na injunction at muling pinasusunpinde ang alkalde at tatlo pang opisyal ng lokal na pamahalan.

Napag-alaman din na bago pa magsampa ng kaso si Erice sa Office of the Ombudsman ay ilang beses na ring nakipag-ugnayan ang lokal na pamahalaan sa mga opisyal ng GSIS upang ayusin ang mga records ng mga city hall employees.

Nang matapos ang reconciliation of records sa GSIS ay agad na nagkaroon ng Memorandum of Agreement (MOA) sa pagitan ni Echiverri at ng mga opisyal ng naturang ahensiya upang tuluyan nang matuldukan ang usapin sa problema ng mga city hall employees.

Sa kasalukuyan ay maayos na ang usapan sa pagitan ng lokal na pamahalaan at ng mga opisyal ng GSIS dahil na rin sa MOA kaya’t nagulat ang kampo ni Echiverri nang muling maglabas ng kautusan ang CA kung saan ay tinatanggal nito ang injunction na naunang nakuha ng kampo ng alkalde.

Nauna na ring nakakuha ng 20 days TRO si Echiverri sa RTC at bago pa matapos ang ibinigay na araw ay naglabas naman ang husgado ng writ of preliminary injunction. “Wherefore, after posting an injunction bond in the amount of Php50,000.00 each by the petitioners in addition to the bond posted for the temporary restraining order and approval thereof by this court pursuant to Section 4, Rule 58 of the Rules of Court, let a Writ of Preliminary Injunction be immediately issued enjoining/restraining the respondents, their representatives or any person acting for and in their behalf from implementing the order of preventive suspension imposed upon the petitioners in OMB-C-A-11-0401-G,” sabi pa sa kautusan ni Judge Sison.
